PUBLIC NOTICE: Town Council To Conduct Public Hearings At Meeting On June 5, 2024

On Wednesday, June 5, 2024 at 1:00 p.m., the Town Council of the Town of Duck will conduct public hearings and consider the following special use permit applications:

SUP 24-003      Pursuant to Section 156.128 of the Duck Town Code, Un Yong Karl & Eva Chin, property owners of 1156 Duck Road, have submitted a special use permit application to amend the locations of a bulkhead and retaining wall previously approved under SUP 23-005 to (1) allow bulkheads or retaining walls to support and contain fill; (2) allow up to four feet (4’) of fill behind the upper retaining wall; and (3) allow up to five feet (5’) of fill behind the lower bulkhead.

SUP 24-004      Pursuant to Section 156.128 of the Duck Town Code, the Four Seasons Owners Association, owner of a neighborhood common property at 0 Duck Road, and Matthew & Jenna McDermott, adjoining property owners of 102 Amy Lane, have submitted a special use permit application requesting the following allowances for fill and grading activities: (1) to allow a bulkhead to support and contain fill, which is not permitted under Subsection 156.128(A)(6); (2) to allow up to eight feet (8’) of fill behind the bulkhead where a maximum of three feet (3’) of fill is permitted in Subsection 156.128(A)(12)(a).

SUP 24-005     Pursuant to Section 156.128 of the Duck Town Code, property owner Mark Wishner has submitted a special use permit application requesting the following allowances for fill and grading activities related to construction of a single-family residence at 109 Settlers Lane: (1) to allow retaining walls to support and contain fill, which is not permitted under Subsection 156.128(A)(6); (2) to allow up to thirteen feet (13’) of fill behind the upper retaining wall where a maximum of three feet (3’) of fill is permitted in Subsection 156.128(A)(12)(a); and (3) to allow up to eight feet (8’) of fill behind the lower retaining wall where a maximum of three feet (3’) of fill is permitted in Subsection 156.128(A)(12)(a).

Box 8369, Duck, North Carolina 27949, or via e-mail at councilmeeting@townofduck.com.  Per State Statute, only the name and address of persons submitting written comments will be provided to the Town Council prior to or at the meeting.  Staff reports will be available approximately five days in advance of the meeting at the Town Administrative offices or via the Town’s website at www.townofduck.com/towncouncil/.
