Planning Board to Consider Conditional Use and Special Exception Requests

The Town of Duck Planning Board will review the following applications at its public meeting on November 12, 2014 at 6:30 p.m.: 

CUP-14-004   Application for a conditional use permit amendment to allow the construction of four (4) new buildings containing a total of 3,840 sf of retail space, a new 24 space parking area, and a new access drive at the Waterfront Shops located at 1240 Duck Road, PIN 985911761465.  As part of the proposal, the access and parking on the adjoining property containing Stan White Realty at 1236 Duck Road, PIN 985911763353, will be amended and relocated.  Additional proposed site improvements include elevated walkways, stormwater management measures, lighting, landscaping and utilities to serve the proposed buildings and parking area.  

SE-14-002       Application for a special exception to allow the concrete deck surrounding a proposed swimming pool at 138 Rakiock Court, PIN 986913041732, to encroach 3.5 feet into the required rear setback of twenty-five feet (25’) in the Single-Family Residential (RS-1) zoning district. 

SE-14-003       Application for a special exception to allow the proposed addition of an elevator to the existing residence at 156 Lone Way, PIN 986913140446, to encroach two feet (2’) into the required southern side setback of ten feet (10’) in the Single-Family Residential (RS-1) zoning district. 

SE-14-004       Application for a special exception to allow several proposed parking spaces on the Stan White Realty property at 1236 Duck Road, PIN 985911763353, to encroach 2.9 feet into the required ten foot (10’) setback from the front property line and five feet (5’) into the required five foot (5’) setback from the southern side property line. 

Following the Planning Board’s recommendation, the Town Council of the Town of Duck is expected to conduct a Public Hearing on December 5, 2014 at 7:00 p.m. to receive comments on this item.  Please note that the Public Hearing date is tentative and could change depending on the outcome of the Planning Board meeting.
