PLANNING BOARD

REGULAR MEETING

December 10, 2004

 

 

The Planning Board for the Town of Duck convened at the Duck Municipal Offices at 2:00 p.m. on Friday, December 10, 2004

 

Present were Chairman Ron Forlano, Marilyn March, and John Jenkins.  Also present were Town Council Liaison Neil Morrison, Planning Director/Zoning Administrator Suzanne Cotellessa and Administrative Assistant Sandy Cady. 

 

Gian Hasbrock of BD&A Realty was present for the meeting.

 

Vice-Chair Jon Britt and Member Anne Darnall were not present.

 

Chairman Forlano called the meeting to order at 2:00 p.m.

 

PUBLIC COMMENTS

 

None.

 

OLD BUSINESS/ITEMS DEFERRED FROM PREVIOUS MEETINGS

 

A. Introduction of  Final Draft CAMA Land Use Plan (scheduled for discussion and consideration in January 2005)

 

Planning Director Cotellessa explained to the Planning Board that in their package was the final draft of the CAMA Core Land Use Plan which was compiled by the Land Use Committee over the past 18 months.  This is a long range plan for Duck.  Ms. Cotellessa asked the Board to focus on Phase 2 which addresses policy statements and vision for the Town.    She further explained that the Land Use committee has been back and forth with CAMA several times and they now feel very comfortable with this Draft.

 

Chairman Forlano and Member Jenkins both noted that there are already issues in the CAMA plan that need to be updated since the completion of the zoning ordinance review.   Mr. Jenkins further pointed out that page III- 6 has some incorrect data.  He indicated Section B&C of Carolina Dunes are 15,000 s.f. lots, and not 10,000 s.f.   It was noted that some goals have already been achieved and some action items are complete.

 

Planning Director Cotellessa acknowledged these comments and requested that the Board submit to her any real time changes that they find in their review of the Plan.

 

Councilor Morrison noted on page IX-25, Objective number 24a should read Outer Banks Visitors Bureau rather than tourist bureau. 

 

NEW BUSINESS

A. Conditional Use Permit 04-001 for a BD&A model home/builder’s showcase at 103 Duck Ridge Village Court – consideration and recommendation to Town Council

 

Gian Hasbrock of BD&A Realty Company was recognized to speak.  He indicated that he had reviewed the staff report and the suggested findings and conclusions.  He only had one minor issue which had to do with the dimensions of the signage as detailed under conditions #2.  He requested that the Board consider revising the sign limitations from a pre-determined size of 4x8 feet to an equivalent maximum square footage of 32 square feet.    Mr. Hasbrook was pleased with the Conditions otherwise.

 

Ms. Cotellessa provided a brief explanation regarding the difference between and open house and a builders showcase/model home.   She explained that a showcase sells a company and/or a development; a showcase does not have to be affiliated with a particular development.   The important difference however is that a showcase has impacts and therefore, it is not a by right use and must be approved by Council. 

 

It was further noted that BD&A was only asking for a 1 year permit with the option to come back before Council for a 2nd year extension at the end of year one.

 

Member March indicated that she would only recommend 1 year.

 

Member Jenkins made a motion to recommend approval of the Conditional Use Permit 04-001 to Town Council incorporating staff’s recommendations with amendments to the signage as discussed this evening. 

 

Chairman Forlano seconded the motion.

 

Motion carried 2-1 with Member March dissenting.

 

APPROVAL OF MINUTES

 

A. November 12, 2004

 

Member March made a motion to approve the minutes.

 

Member Jenkins seconded the motion.

 

Minutes for November 12, 2004 were approved 3-0.

 

OTHER BUSINESS

 

None.

 

STAFF COMMENTS

 

Planning Director Cotellessa noted that the Board had before them a fully updated copy of the zoning ordinance. 

 

Ms. Cotellessa advised the Board that Administrative Assistant Sandy Cady would be in Chapel Hill next week for an Introduction to Zoning Course.

 

Lastly, she advised that Board that she met with Angela Beckman from the Duck Community Business Alliance yesterday and the DCBA will be sending an email to the business community to remind business owners that the amnesty for signs will be expiring shortly.   Ms. Cotellessa indicated that she has also had discussions with Linda Dean, who is the contact for the Outer Banks Association of Realtors, with the hopes of educating the realtors regarding the Town’s signage regulations.

 

There was brief discussion regarding some of the sign permits that have been received to date.

 

BOARD COMMENTS

 

Chairman Forlano commented that the Mayor and Council have recently expressed their gratitude for the work that the Planning Board has done this year and Mr. Forlano wanted to thank the Board and staff for a job well done.

 

ADJOURNMENT

 

Chairman Forlano moved to adjourn the meeting.

 

Motion carried 3-0.  The time was 2:50 p.m.
